By using or accessing our Services in any manner or by entering into any other agreement with Slice that governs your use of or access to the Services, you acknowledge that you accept the practices and policies outlined below, and you hereby consent on behalf of yourself and any organization or company that you represent (together “you” and “your”) that we will collect, use and share your information as described in this Privacy Notice. Remember that your use of Slice’s Services is at all times subject to our Terms of Service, which incorporates this Privacy Notice. Any terms we use in this Notice without defining them have the definitions given to them in the Terms of Service. If you do not agree with this Privacy Notice, do not access or use the Services.

UPDATES TO THIS NOTICE

We may update this Notice based upon evolving laws, regulations and industry standards, or as we may make changes to our business. We will post changes to our Notice on this page and encourage you to review our Notice when you use our Services to stay informed. Personal information does not include (i) information that is considered publicly available under applicable laws; (ii) de-identified or aggregated personal information; or (iii) information otherwise excluded from applicable law. We do not knowingly collect any personal information that would be considered “sensitive” under applicable law. However, to the extent any of the personal information we collect would be considered “sensitive,” we only use and disclose such information for purposes permitted by applicable law.

Categories of Sources

We collect the categories of personal information listed above from the following categories of sources:

(i) directly from consumers (e.g., forms, surveys, responses, or other direct interactions from or with consumers);

(ii) indirectly from consumers (e.g., consumer activity online, interactions with our Services and other sites);

(iii) Service providers (e.g., we may use analytics service providers to analyze how you interact and engage with the Services, or third parties may help us provide you with customer support);

(iv) restaurant clients (i.e., restaurants that subscribe to our Services); 

(v) social networks (if you provide your social network account credentials to us or otherwise sign in to the Services through a third-party site or service, some content and/or information in those accounts may be transmitted into your account with us); 

(vi) advertising partners (we receive information about you from some  third parties who assist us with marketing or promotional services related to how you interact with our websites, applications, products, services, advertisements or communication); and

(vii) government entities or databases, or other public records. 

Information Collected Automatically

The servers used to operate and provide the Services may collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Services, including Internet Protocol (“IP”) addresses assigned to the computers and other devices from where you access the Internet, your Internet Service Provider (ISP), device ID numbers and unique identifiers, your media access control (MAC) address, your operating system, your computer screen resolution, your web browser type, the pages you access on the Services, the websites you access before and after visiting the Services, the length of time you spend on the Services, date and time stamps, clickstream data, your approximate geographic location, performance statistics, and usage data. Slice may use this information to administer the Services and its servers, to generate statistical information, to monitor and analyze Services traffic and usage patterns, to monitor and help prevent fraud, to investigate complaints and violations of our policies, and to improve the Services. We may combine this information with other information obtained through the Services (including personal information) and information obtained from third parties (to the extent permitted by law) for security reasons and to protect our rights or the rights of others. The suppliers that we use to provide the Services may collect information about your visits to the Services and other websites. Some of this information may be collected using cookies and similar tracking technologies as explained below. The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data – usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). In addition, we use Hotjar Limited (“Hotjar”) in order to better understand your needs and to optimize this service and experience.   • Retargeting/Advertising Cookies. Retargeting/Advertising Cookies and other unique identifiers collect data about your online activity and identify your interests so that we can provide advertising that we believe is relevant to you. You can decide whether or not to accept Cookies through your internet browser’s settings. Information about Interest-Based Advertisements

We may serve advertisements, and also allow third-party ad networks, including third-party ad servers, ad agencies, ad technology vendors and research firms, to serve advertisements through the Services. These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors (“Interest-Based Ads”). Information for Interest-Based Ads (including personal information) may be provided to us by you, or derived from the usage patterns of particular users on the Services and/or services of third parties. Such information may be gathered through tracking users’ activities across time and unaffiliated properties, including when you leave the Services. To accomplish this, we or our Service Providers may deliver Cookies, including a file (known as a “web beacon”) from an ad network to you through the Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Web beacons allow ad networks to view, edit or set their own Cookies on your browser, just as if you had requested a web page from their site. Please remember that changing your settings with individual web browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time. Your device may also include a feature (“Limit Ad Tracking” on iOS or “Opt Out of Interest-Based Ads” on Android) that allows you to opt out of having certain information collected through apps used for behavioral advertising purposes.

HOW WE USE YOUR PERSONAL INFORMATION

We may use or disclose the personal information we collect for one or more of the following commercial or business purposes (each, a “Business Purpose”):

  • To meet or fulfill the reason you provided the information to us, such as performing services on your behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytic services, or providing similar services on behalf of the business or Service Provider.
  • To communicate with you about the Services, including Service announcements, updates or offers.
  • To provide support and assistance for the Services.
  • To create and manage your account or other user profiles.
  • To personalize website content and communications based on your preferences, including targeted offers and ads served through the Services.
  • To respond to user inquiries and fulfill user requests.
  • To improve and develop the Services, research and analysis.
  • To detect security incidents, and to protect against or deter fraudulent, illegal or harmful actions and maintain the safety, security and integrity of our Services, and to prosecute those responsible for such activity.
  • To conduct auditing related to a current interaction and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  • To debug, identify and repair errors that impair existing intended functionality.
  • To undertake internal research for technological development and demonstration.
  • To verify or maintain the quality or safety of a service or device that we own, manufacture (or that was manufactured for us) or control.
  • To process your application for job opportunities with Slice.
  • To comply with our legal or contractual obligations, resolve disputes, and enforce our Terms of Service.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To evaluate or consummate a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information is among the assets transferred. For any other business purpose as disclosed to you when collecting your personal information or as permitted under applicable law.

We do not use your personal information to profile you in furtherance of decisions that produce legal or significantly similar effects (as may be defined under applicable law). We do not sell your personal information as the term “sell” is commonly understood to require an exchange for money. However, please note that our use of advertising and analytics cookies on our Services may be considered a “sale” / “sharing for cross-contextual behavior advertising purposes” of personal information as these terms and similar terms and concepts are defined under applicable data protection laws. In the preceding 12 months, we have “sold” and “shared” for cross-contextual behavioral advertising purposes Internet or other electronic network activity information, as defined in the table above and the cookies and other data as described in the “Information Collected Automatically” section above, to analytics and marketing providers for the business purposes described above. You may have the right to opt-out of such “selling” and “sharing” as further detailed in the section below, “Your Privacy Rights and Choices.” We do not have actual knowledge that we “sell” or “share” personal information of residents under 16 years of age.

Analytics, Advertising, and Retargeting

Slice engages other entities for analytics services. These entities may use cookies and other tracking technologies to analyze your usage of our Web Sites and Applications. In addition, we engage other entities to serve advertisements on the Web Sites and Applications and/or on other services. These entities may use cookies and other tracking technologies to collect and share information with us about your visits to this and other services in order to provide advertisements about goods and services likely to be of greater interest to you, measure and research the effectiveness of our advertisements, track page usage and paths followed during visits through our Web Sites and Applications, help us serve relevant internet banner advertisements on our Web Sites and Applications and on other services, and track use of our internet banner advertisements and other links from our business partners' services to our Web Sites and Applications. Slice may use the information collected on its Web Sites and Applications for online behavioral advertising purposes including retargeting and to customize ads to you when you visit other services (“Interest-based Advertising”). We also use audience matching services (which is a type of Interest-based Advertising) to reach people (or people similar to people) who have visited our Web Sites, Applications, or are identified in one or more of our databases ("Matched Ads"). This is done by us uploading a customer list to a technology service or programmatically by incorporating technologies such as pixels, SDKs, or APIs from a technology service into our own Web Sites or Applications, and the technology service matching common factors between our data and their data. For instance, we incorporate the Facebook pixel on our Web Sites and may share your email address with Facebook as part of our use of Facebook Custom Audiences. Some technology services may provide us with their own data, which is then uploaded into another technology service for matching common factors between those datasets.

Google’s ability to use and share information collected by Google Analytics about your visits to the Services is subject to the Google Analytics Terms of Use and the Google Privacy Policy (see How Google uses data when you use our partners' sites or apps for more information). You have the option to opt-out of Google’s use of Cookies by visiting the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout/. Through Google Ads, Google uses your Internet searches, cookies, and similar identifiers (e.g., pixel tags) to collect information about your visits to the Services and your interaction with our products and services to generate targeted advertisements to you on other websites that you visit across the Internet. We may also enable and implement the following Google Analytics Advertising Features on the Services: Remarketing with Analytics, Demographics and Interest reporting, Campaign Manager integration, Display & Video 360 integration, Google Display Network (“GDN”) Impression Reporting, and Segments. Remarketing with Analytics uses Google Analytics cookies to serve advertisements to you across the Internet based on your visits to and use of the Services. Demographics and Interest reporting uses a third-party cookie to collect information about our Services traffic by tracking users across websites and across time, which generates a report for us to better understand the users of our Services. Campaign Manager integration allow us to view, analyze, and create remarketing lists using our Campaign Manager data in Google Analytics. Display & Video 360 integration allows us to create remarketing lists in Google Analytics and have those lists available in Display & Video 360. GDN Impression Reporting allows us to measure the impact of unclicked GDN Display ad impressions on website behavior and conversions. Segments allows us to isolate and analyze subsets of the users of our Services by sorting our Google Analytics data. To opt out of remarketing advertising provided through Google, to customize your ad preferences, or to limit Google’s collection or use this information, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Opting out will not affect your use of the Services.

As indicated above, the entities providing these services may act as our service providers, or in certain contexts, independently decide how to process your information. Information collected by these services may be transmitted to and stored on servers in the U.S. (or elsewhere). We encourage you to familiarize yourself with and consult their privacy policies and terms of use. HOW WE DISCLOSE YOUR PERSONAL INFORMATION

We may disclose your personal information to the following categories of third party recipients for the business purposes identified above:

  • Service providers (which include IT and cloud hosting companies, payment providers, transactions reporting providers, customer relationship management, email marketing providers, analytics providers, and providers of administrative services)
  • Restaurant clients
  • Restaurant delivery partners (delivery partners who have a direct relationship with restaurant clients)
  • Social networks
  • End-users (other users of the Services)
  • Third parties in the context of a merger, divestiture, restructuring, reorganization, bankruptcy, dissolution, or other sale or transfer of some or all of our assets.

YOUR PRIVACY RIGHTS AND CHOICES

Review and Update of Account Information

You have the right to access certain account information that you have voluntarily submitted to us through our Services. You may correct, update, amend, delete, or remove that information by making the change within your Slice online account or contacting us as set forth in the section entitled "Contact Us" below. We may require additional information from you to allow us to confirm your identity. Please note that we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Tracking Technologies Generally

Most web browsers (such as Microsoft Internet Explorer, Google Chrome, Firefox and Apple Safari) accept cookies by default. You can instruct your browser, by changing its settings, to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations. For Apple iOS, we will only receive access to your device’s Ad ID (known as an IDFA) if you provide consent. You can reset your device advertising Id at any time through your device settings, which is designed to allow you to limit the use of information collected about you. The location data collected through an app depends on your device settings and app permissions. You can exercise choice over the location data collected through our apps by (i) for GPS data, disabling location in your device settings or disabling location permissions to that app; (ii) for Bluetooth data, disabling Bluetooth and any Bluetooth scanning option in your device settings; or (iii) for WiFi data, disabling WiFi and any WiFi scanning option in your device settings. You can stop collection of all location data via an app by uninstalling the app. If you disable cookies or other device tracking features, however, you may not be able to use certain functions of our Services.

Analytics and Interest-based Advertising

Opting out only means that those selected members should no longer deliver certain interest-based advertising to you, but does not mean you will no longer receive any targeted content and/or ads (e.g., from other ad networks). To opt out of us using your data for Matched Ads, please contact us as set forth in the "Contact Us" section below and specify that you wish to opt out of Matched Ads. We will request that the applicable technology company not serve you matched ads based on information we provide to it. We will also remove your email address from any subsequent lists disclosed to ad partners for Matched Ads purposes. Alternatively, you may directly contact the applicable technology service to opt out. You may also limit our use of information collected from or about your mobile device for purposes of serving targeted ads to you by going to your device settings and selecting "Limit Ad Tracking" (for iOS devices) or "Opt out of Interest-Based Ads" (for Android devices). Please note that if you opt out using any of these methods, the opt out will only apply to the specific browser or device from which you opt out. Slice is not responsible for effectiveness of, or compliance with, any other parties' opt out options or programs or the accuracy of their statements regarding their programs.

Communications Opt Out

In order to provide service to you, we may send you communications related to your transactions, security or the administration of the Web Sites or Applications. From time to time, Slice may also send you other messages or updates about our Web Sites, Applications, Slice, or our Promotions and other activities. If you do not wish to receive promotional communications from Slice, you can opt out at any time by following the unsubscribe instructions provided in those communications or by contacting us as set forth in the section entitled "Contact Us" below. Please note that even if you opt out of receiving promotional communications, we may continue to send you non-promotional emails, such as those about your account, servicing, or our ongoing business relations. Please note that Slice will not share text message originator opt-in data and consent information with third parties for their own marketing purposes; however, as provided in the “How We Share Your Personal Information” section, Slice may share such information with service providers in order to deliver text messages to recipients who have agreed to receive such messages, provided that such service providers are not permitted to share or sell that information to third parties for their own marketing purposes. If you call us or our Service Providers, including one of our restaurant partners, we may ask for your consent to record the telephone conversation and any personal information disclosed during such telephone conversation. We use these recordings to provide the Services to you and fulfill your orders, as well as to improve customer service for us and the applicable restaurant. Note that, even if you opt out of receiving communications from Slice, you may still receive administrative communications from us with respect to your use of the Services.

State-Specific Rights

Applicable laws in your jurisdiction may grant you certain rights—subject to all applicable limitations, exemptions, or exceptions—regarding our collection and use of your personal information. These rights may include, to the extent applicable and to the extent granted under applicable law:

  • The right to confirm whether personal information about you is processed and to access such personal information;
  • The right to request the disclosure of (1) what personal information has been collected; (2) the categories of sources from which the personal information was collected; (3) the business or commercial purpose for collection or selling Personal Information; (4) the categories of third parties with whom we share personal information; and (5) the specific pieces of personal information we have collected about you (e.g., data portability);
  • The right to request the deletion of your personal information that we have collected;
  • The right to request the correction of your personal information that we collected;
  • The right to opt-out of targeted advertising and the sharing of personal information for cross-context behavioral advertising purposes;
  • The right to opt-out of the sale of your personal information;
  • The right to withdraw consent of our processing of your personal information where consent was required by law prior to the initial collection and processing of your personal information;

When you submit a request or launch an appeal, we will limit our collection of your information to only what is necessary to securely fulfill your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal. Nevada Residents. If you are a resident of Nevada, you may have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A.

California Residents. In addition to the rights described above, California law permits residents to request certain details about how their “personal information” (as defined in California Civil Code Section 1798.83) is shared with third parties for their direct marketing purposes. When you use the Services to place an order with a restaurant, we may share certain personal information about you with that restaurant, which may use it for its own direct marketing purposes. California residents may, under certain circumstances, obtain the categories of personal information shared and the names and addresses of all third parties that received personal information for their direct marketing purposes during the immediately prior calendar year. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. SOCIAL MEDIA

The Services may allow you to connect to and share information with social media platforms and we may be required to implement cookies, plug-ins, and APIs provided by those social media platforms in order to facilitate those communications and features. We may share information that you provide us or that we may collect about your use of the Services with those platforms and that information will be subject to their privacy policies. We encourage you to review the privacy policy of any social media platform that you use in connection with the Services. In addition, by choosing to use any third-party social media platform or choosing to share content or communications with any social media platform, you allow us to share information with the designated social media platform. We cannot control any policies or terms of such third party platform. As a result, we cannot be responsible for any use or disclosure of your information or content by third-party platforms, which you use at your own risk. Slice is active on social media. You may have the opportunity to comment on those social media platforms regarding Slice and the products we offer and/or to submit or upload related photographs and other materials. DATA SECURITY AND RETENTION

We seek to protect your personal information from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of personal information and how we are processing that data. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account.
